Terms of Service for Maple Court Tennis Studio

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services, facilities, programs, websites, booking systems, communications, and related offerings provided by Maple Court Tennis Studio (“Maple Court Tennis Studio,” “we,” “us,” or “our”). By booking, registering for, attending, or otherwise using any of our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our services. If you are under the age of majority in your province or territory, a parent or legal guardian must review and accept these Terms on your behalf and remain responsible for your participation.

These Terms are intended to be interpreted in accordance with applicable laws in Canada, including consumer protection, privacy, contract, and negligence principles, as applicable.

2. Scope of Services

Maple Court Tennis Studio provides tennis-related instruction and training services, which may include:

  • Private tennis coaching
  • Group tennis lessons
  • Junior development programs
  • Adult beginner clinics
  • Competitive match play training
  • Serve and stroke technique analysis

Services may be delivered in person, outdoors or indoors, at our facilities or at third-party venues, or through digital/remote communications where applicable. We may modify, suspend, or discontinue any service, class, coach assignment, schedule, or location at any time, subject to applicable law and any specific booking or program terms disclosed at the time of registration.

We do not guarantee any particular athletic outcome, ranking, match result, injury prevention, or performance improvement. Tennis instruction is inherently physical and may involve risk of minor or serious injury.

3. User Obligations and Responsibilities

By using our services, you agree that you will:

  • Provide accurate, current, and complete registration, health, and contact information;
  • Promptly update us if your information changes;
  • Follow all instructions, safety rules, facility rules, and coach directions;
  • Use appropriate tennis attire and footwear suitable for the surface and activity;
  • Disclose any relevant medical conditions, injuries, allergies, limitations, or other circumstances that may affect safe participation;
  • Ensure that minors are supervised as required and are picked up on time after sessions;
  • Refrain from abusive, disruptive, discriminatory, harassing, or unsafe conduct;
  • Respect other participants, staff, coaches, equipment, and property;
  • Not attend sessions while significantly ill, intoxicated, or otherwise unable to participate safely;
  • Comply with all applicable laws and regulations while using our services.

You are responsible for your own personal property. We are not responsible for lost, stolen, or damaged personal items except to the extent required by applicable law.

If you are registering a child or dependent, you represent and warrant that you are the parent or legal guardian, or otherwise authorized to consent to participation and to these Terms.

4. Payment Terms and Conditions

Fees for services, memberships, packages, clinics, assessments, and other offerings will be communicated at the time of booking or registration, or otherwise posted by Maple Court Tennis Studio. Unless expressly stated otherwise:

  • All fees are payable in Canadian dollars (CAD);
  • Payment may be required in advance to confirm a booking;
  • Taxes, including applicable sales taxes, may be added where required by law;
  • Late, declined, reversed, or failed payments may result in suspension or cancellation of services;
  • Any chargeback or payment dispute must be raised with us promptly and in good faith.

We may use third-party payment processors. Your use of such payment services may also be subject to the processor’s terms and privacy practices. We are not responsible for errors or delays caused by third-party payment providers, banks, or card issuers.

Promotional pricing, discounts, vouchers, and credits are subject to stated conditions and may be withdrawn or modified at any time where permitted by law. Unless expressly stated otherwise, credits and packages are non-transferable and have no cash value.

5. Cancellation and Refund Policy

Cancellations and refunds are subject to the specific program or booking terms provided at registration, as well as applicable law. If no specific policy is provided, the following general terms apply:

  • Private lessons: cancellations made with reasonable advance notice may be rescheduled subject to coach availability;
  • Group lessons and clinics: missed sessions due to participant absence are generally non-refundable;
  • Junior and adult programs: refunds may be prorated only where required by law or expressly approved by us;
  • Weather, facility closures, or other operational disruptions may result in rescheduling, credit, or alternative arrangements at our discretion, subject to applicable law;
  • No refund will be provided for removal from a session or program due to misconduct, safety violations, or failure to comply with these Terms.

Where a refund is approved, it will generally be issued using the original payment method, unless otherwise required or permitted by law. Administrative fees, processing fees, or non-recoverable third-party costs may be deducted where permitted.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection legislation in Canada or in the province or territory where the service is provided.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Court Tennis Studio, its owners, directors, officers, employees, contractors, coaches, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of data, loss of enjoyment, or business interruption arising out of or related to your use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount you paid to us for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to the claim, or the minimum amount required by applicable law, whichever is greater.

You acknowledge and agree that participation in tennis and related athletic activity involves inherent risks, including but not limited to slips, falls, collisions, overuse injuries, strains, sprains, fractures, heat-related illness, equipment-related injury, and risks associated with travel to and from sessions. You voluntarily assume all such risks to the fullest extent permitted by law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by negligence where such exclusion is not permitted.

7. Intellectual Property Rights

All content, materials, training plans, drills, assessments, videos, photographs, logos, trademarks, text, graphics, and other intellectual property provided by Maple Court Tennis Studio are owned by or licensed to us and are protected by applicable intellectual property laws.

You may use our materials solely for your personal, non-commercial use in connection with the services. You may not reproduce, distribute, modify, publicly display, sell, sublicense, or create derivative works from our materials without our prior written consent.

Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation, to the extent permitted by law.

If you submit photos, videos, testimonials, or other content to us, you grant Maple Court Tennis Studio a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, and adapt such content for operational, promotional, educational, and archival purposes, subject to applicable law and any separate written consent requirements for minors.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

Personal information may include your name, contact details, payment information, emergency contact information, health or injury information relevant to safe participation, attendance records, and communications related to your services.

We may use personal information to:

  • Register and manage your account, bookings, and participation;
  • Process payments and refunds;
  • Communicate schedules, updates, safety notices, and service-related information;
  • Assess suitability for programs and provide coaching services;
  • Maintain records required for business, legal, tax, or insurance purposes;
  • Improve our services and operations;
  • Comply with legal obligations and enforce these Terms.

We may share personal information with service providers who assist us in operating our business, such as payment processors, scheduling platforms, email providers, and insurance or legal professionals, subject to confidentiality and data protection obligations where appropriate.

We take reasonable administrative, technical, and physical safeguards to protect personal information, but no method of transmission or storage is completely secure. You acknowledge that you provide information at your own risk, subject to applicable law.

9. Force Majeure

Maple Court Tennis Studio shall not be liable for any delay, failure, or interruption in performance caused by events beyond our reasonable control, including but not limited to severe weather, fire, flood, power outage, epidemic or pandemic-related restrictions, labour disputes, government orders, facility closures, transportation disruptions, equipment failure, civil unrest, or acts of God.

In such circumstances, we may reschedule services, provide credits, offer alternative delivery methods, or suspend services for the duration of the event, subject to applicable law and operational feasibility.

10. Changes to Terms

We may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The revised Terms will be effective when posted or otherwise communicated to you, unless a later effective date is stated.

Your continued use of our services after the effective date of revised Terms constitutes acceptance of the updated Terms, to the extent permitted by law. If you do not agree to the revised Terms, you must discontinue use of our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your use of the services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Subject to any mandatory consumer protection or small claims rights that cannot be waived, you agree that the courts located in Ottawa, Ontario shall have exclusive jurisdiction and venue over any dispute arising from or relating to these Terms or the services.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. If necessary, the invalid provision shall be replaced with a valid provision that most closely reflects the original intent of the parties and is enforceable under applicable law.

By using the services of Maple Court Tennis Studio, you acknowledge that you have read, understood, and agree to these Terms of Service.
